FitQuest is a sole proprietorship registered in Ontario, Canada ("FitQuest", "we", "us"). These terms govern your use of the FitQuest website and application.
Where these terms and your signed client agreement differ, the signed client agreement wins.
FitQuest sells ongoing health coaching — the stewardship of your health by a coach over time. The app exists to extend that relationship, not to replace it.
FitQuest is not medical care. Your coach is a fitness professional, not a physician, dietitian, physiotherapist or psychotherapist, and nothing in the app or from your coach is medical advice, diagnosis or treatment. Talk to a qualified health professional before starting or changing an exercise or nutrition programme, and especially if you have a medical condition, are pregnant, are injured, or are taking medication.
Physical activity carries risk. By using FitQuest you accept that exercise involves risk of injury. Complete the PAR-Q honestly, tell your coach about anything that changes in your health, and stop if something hurts.
If you are having a medical emergency, call 911. Do not use the app.
Do not: break the law; impersonate someone; try to access another member's records; probe, scan or attack the service; scrape it; resell or redistribute FitQuest programming or education as your own; upload malware; or use FitQuest to harass anyone.
We may suspend an account for any of the above. We will not withhold help with a genuine health need over a billing or conduct dispute — that is a founding commitment, not a courtesy.
You may cancel within ten days of receiving your written agreement, for any reason or no reason, and receive a full refund with no penalty. This is a statutory right under Ontario's Consumer Protection Act. It is unconditional, it cannot be waived, and nothing in these terms limits it. If you are near the boundary, the tenth day counts.
FitQuest offers a first-30-day guarantee conditioned on effort, not on results. If you do the work as agreed with your coach and are not satisfied, everything you have paid in that time is refunded. Thirty calendar days — not a number of billing periods, so the cadence you are billed on cannot shorten it. We do not guarantee outcomes — no honest coach can, because results depend on factors outside anyone's control, and promising them would contradict our own founding documents.

Attendance and adherence are already tracked as part of coaching, so eligibility is a matter of record rather than of argument. Genuine edge cases are resolved generously.
We do not use countdown timers, fake scarcity, artificial urgency, or hard-to-find cancellation. If you ever encounter one on a FitQuest surface, it is a bug — tell us and we will remove it.
Every FitQuest membership includes all six components of the coaching method: assessment, strategy, implementation, education, adjustment and review. The quality of coaching does not vary with what you pay. What varies is how much personalised attention a coach can give you — how many days in your week a coach designs specifically for you.
Care is never gated by price. When your health requires an adjustment — injury, illness, a real change in circumstances — you get help, regardless of your membership level.
You keep ownership of what you put into FitQuest: your answers, your logs, your photos. You grant us permission to store and process it only as needed to provide the service and as described in the Privacy Policy.
FitQuest has no public feed. Nothing you enter is shown to other members.
If you want your photo, name or testimonial used in marketing, that requires a separate, specific, written release — it is never implied by using the service, and you can withdraw it later.
The FitQuest programme, curriculum, instruments, framework and software belong to FitQuest. Your membership gives you a personal, non-transferable licence to use them for your own health. You may not resell, republish or teach them as your own material.
We aim to keep FitQuest running but do not guarantee uninterrupted service. We may change or discontinue features. If we discontinue something you are paying for, we will tell you and make it right.
For the software and the website. To the maximum extent Ontario law permits, FitQuest's total liability arising out of your use of the FitQuest website and application — including data loss, downtime, and errors in the app — is limited to the amount you paid FitQuest in the twelve months before the claim arose. We are not liable for indirect or consequential loss of that kind.
For coaching and physical training. This section does not apply. Those risks are addressed in the Informed Consent and Liability Waiver you signed. Where this section and that waiver differ, the signed waiver governs.
What is never limited. Nothing in these terms limits or excludes liability that cannot be limited or excluded by law. That includes: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; the statutory warranties imported by section 9 of Ontario's Consumer Protection Act; and your rights under that Act generally, including the ten-day cancellation right in section 4.1 above.
You agree to cover FitQuest's reasonable costs if a third party brings a claim against us because of something you did wrong — specifically: content you uploaded that you did not have the right to upload; your use of FitQuest to break the law or infringe someone's rights; or your breach of section 3 or section 7 of these terms.
This does not apply to any claim arising from FitQuest's own acts, omissions or negligence, and it does not apply to a claim you bring against us.
These terms are governed by the laws of Ontario and the applicable federal laws of Canada.
If something goes wrong, contact us first. Most problems are a misunderstanding and get solved in a conversation. We will respond within five business days and try in good faith to resolve it.
This step is optional and waives nothing. You keep every right you have under the Consumer Protection Act, including the right to bring or join a class proceeding, and including the right to complain to a regulator at any time. You do not have to talk to us first.
If we change these terms materially we will give you notice before the change takes effect. Continuing to use FitQuest after that means you accept the new version; if you do not, you may cancel. We keep a record of which version you accepted and when.
FitQuest currently sells to residents of Canada, outside Quebec. If you are somewhere else, checkout will not be available to you yet. We would rather tell you that plainly than take your money before we can meet the obligations your jurisdiction places on us.
Quebec specifically. Quebec's privacy law asks more of us than we have finished building — a published privacy officer and written agreements with every service we use. That is our gap, not yours, and we would rather close it before taking your money than after.
